Terms & Conditions

1. Scope / Contracting party

These terms and conditions apply only to distance contracts between you and your contracting party, Heinz Bauer Manufakt GmbH, Robert-Scott-Str. 3, 72768 Reutlingen, Germany (hereinafter: Heinz Bauer Manufakt), and end customers for the supply of goods, both nationally and internationally.

2. Conclusion of contract / Delivery

The contract is concluded in the German language. The purchase contract comes into effect when we accept your order by delivering the goods or by notifying you of dispatch.

3. Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, take possession of the goods. 4. Payment terms, prices and costs

In the case of payment by credit card, the invoice amount is debited from your credit card account immediately. We accept credit cards from MasterCard, American Express, Discover Card and Visa, as well as payments via PayPal. Please note that for payments from outside Germany, payment can only be made by credit card or PayPal. In the case of payment by direct debit, the invoice amount is debited from your account immediately, unless otherwise agreed. All prices stated in these terms and conditions and in our online shop include the applicable statutory VAT. Shipping costs apply to the dispatch of the ordered goods. Exclusion or early expiry of the right of withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or decision by the consumer is decisive, or which are clearly tailored to personal requirements (e.g. made-to-measure items, monogram embroidery).

5. Retention of title

The delivered goods remain the property of Heinz Bauer Manufakt GmbH until full payment has been made.

6. Liability

Claims for damages by the customer are excluded, unless otherwise provided for by the following reasons. This also applies to representatives and vicarious agents of the seller, if the customer asserts claims for damages against them. Excepted from this are claims for damages by the customer arising from injury to life, body or health, or from the breach of essential contractual obligations, as well as liability for other damages based on an intentional or grossly negligent breach of duty by the seller or one of its representatives or vicarious agents.

7. Online dispute resolution pursuant to Art. 14(1) of the ODR Regulation

The European Commission provides a platform for online dispute resolution (ODR), which you can find at http://ec.europa.eu/consumers/odr/. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

8. Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Reutlingen, provided that the customer is a merchant or a legal entity under public law.
